Terms and conditions Article 1: OBJECT 1.1. TOTAL Group, registered office 2, place Jean Millier, La Défense 6, 92400, Courbevoie, France, registered with the Nanterre Company and Trade Register under number 542 051 180, organises a free online contest from November 25, 2009 to January 25, 2010. No purchase is necessary to enter or win. This Contest is named Operation Total Team for the Raid Total Centrale Paris (hereafter referred to as the "Contest"). 1.2. The Contest (including its updates) is accessible exclusively at www.team-total.com (hereafter referred to as the "Site"). 1.3. How to enter the Contest: - The Contest is open to residents of France and other countries. The Contest is exclusively open to higher education students in the fields of commerce, engineering and science. - The purpose of the Contest is to select projects submitted by groups of 4 students of the same school (hereafter referred to as the "crew") who will receive a monetary award as defined in article 4 of these Terms and Conditions (hereafter referred to as "Terms and Conditions"). - Applications may be submitted and modified beginning November 25, 2009 and ending January 25. 1.4. All of the 4 members of a crew must meet the eligibility criteria in order to win. Article 2: HOW TO ENTER 2.1. The Contest is announced through a poster and flyer communication campaign in the selected schools. An e-mail is sent to the students and associations of the colleges for which TOTAL has the e-mail addresses. 2.2. Participation in the Contest is strictly limited to the Internet during the first phase of the Contest (from November 25, 2009 to January, 2010). The Contest Site is: www.team-total.com . The Site may be accessed from a computer connected to the Internet. Since Internet connection is provided free of charge at schools, Internet connection fees will not be refunded. 2.3. The Contest is open to individuals who are students of legal age on the first day of the Contest (November 25, 2009) and who are enrolled in one of the colleges or universities concerned. All of the 4 members of a given crew must be students in the same university or college specialising in commerce, engineering or science. Please note: no more than two schools may be represented on each crew. Crews must have 4 members (3 participating members and 1 substitute). These schools must be higher education institutes in the fields of commerce, engineering and science, which have been authorised to participate. 2.4. No one contestant may belong to more than one (1) crew and as a result, only one application is authorised per contestant. 2.5. Participation is dependent on the submission of an application by each crew at the Site. The application must include all required information (such as school name, personal data for all four crew members, description, motivation, and e-mail addresses). 2.6. Each crew directly pre-enrols with the Raid Total Centrale Paris organising committee at www.raidecp.com. Pre-enrolment fees amount to EUR 150 per crew member. If the crew is selected to join Team Total, the Raid Total Centrale Paris organising committee will refund all the expenses paid for pre-enrolment in the Raid Total Centrale Paris. 2.7. Crews submitting both applications with one or more incomplete required fields will be automatically disqualified. If the application of only one Crew member is incomplete, he or she is notified by e-mail and invited to correct the application. 2.8. An e-mail is sent to both Crew members within two hours of submitting the application. This e-mail confirms participation of the Crew in the Contest. Article 3: PRIZES The following prizes are offered by Team Total for the Raid Total Centrale Paris: 3 grants valued at €450. This sum corresponds to the enrolment fees paid by each Crew to participate in Raid Total Centrale Paris (enrolment fees per individual amount to €150). The selection committee reserves the right to award grants for the most popular video to additional Crews. Prize money is not awarded directly to winning Crews. TOTAL directly transfers prize money to Raid Total Centrale Paris on behalf of the crew. Article 4: SELECTION OF WINNERS 4.1. Selection of winners of the Total Team Contest Phase 1: Submission of applications From November 25, 2009 to January 25, 2010 Enrolment and submission of applications and videos takes place on the Total Team Site (www.team-total.com), starting on November 25 and ending on January 25 at 12:00pm following the procedure outlined in article 2. Phase 2: Selection of Crews by the Total managers selection committee From November 25, 2009 to February 1st, 2009 Applications are examined by a selection committee made up of Total managers. This measure does not apply to the grant awarded for the most popular video. The selection committee examines the applications based on the following criteria: •The athletic ability of each crew member • why and how the Crew is involved in the project; • how far along the project is; • how the Crew shares the Group's main values, namely team spirit, challenge and breaking the limits; • why the Crew members would be good Campus Managers; • how original the video is. • Phase 4: The Preliminaries for selecting the finalist crews (except for foreign crews) will be held February 13, 2010:The crews wining the 3 Team Total grants for the Raid Total Centrale Paris will be announced at this time. 4.2. Winning Crews agree to pay any and all applicable taxes, duties, social security contributions or other levies as required by law. TOTAL is released from all liability in this respect. 4.3. Medical reasons are the sole acceptable grounds for replacing a Crew member of a winning crew. The substitute Crew member must be enrolled at the same school as the remaining Crew member. 4.4. Winning Crews agree not to accept the sponsorship of any other sponsor from the oil industry or related industries (such as lubricant manufacturers). Article 5: RELEASE OF LIABILITY 5.1. Contestants acknowledge that they are aware of and accept the limits of the Internet, in particular with regard to technical performance, speed of data consultation or transmission, risk of interruption, and other general risks inherent to Internet connection and use such as viruses and insufficient protection of data. 5.2. Under no circumstances may TOTAL be found liable for the following (non-exhaustive list): - contents of the services consulted on the Site and, more generally, all information and/or data available via the services consulted on the Site; - transmission and/or reception of all data and/or information by Internet; - Internet malfunction preventing smooth functioning of the Contest; - failure of any Internet receiver or line; - loss of any electronic or conventional mail and, more generally, of any loss of data; - routing problems; - software problems; - any virus, data-processing bug, anomaly, or technical failure; - damage to the computer of a contestant; - any and all technical, material and software failure that prevents or limits the possibility of taking part in the Contest or damages the system of a Crew or one of its members. 5.3. Under no circumstances may TOTAL be found liable for any direct or indirect damage resulting from an interruption, malfunction, suspension or cancellation of the Contest, or for any direct or indirect damage resulting from connection to the Site. All Crews must take appropriate measures to protect their personal data and/or software on their personal computer equipment. All Site users access the Site and participate in the Contest at their own risk. 5.4. Under no circumstances may TOTAL be found liable for any incidental or accidental damages. 5.5. TOTAL reserves, in all cases, the right to modify any or all previously published dates or times. Modified dates or times take effect immediately on the Site. 5.6. TOTAL reserves the right not to publish the remarks made by Crews at the "Contact and FAQ" section of the Site. 5.7. Any modifications made to the Contest are announced online at the Site and are considered as modifications to the present Terms and Conditions and as such are deposited with Alain SARAGOUSSI, Bailiff, 79 rue Réaumur, 75002, Paris, France. Article 6: SUPPORTING DOCUMENTATION 6.1. Except in the case of obvious error, TOTAL is authorised to use for its own purposes, and especially for the purpose of establishing authenticity, correctness, or omission, all programs, data, files, recordings, operations or other elements (such as monitoring reports) in either digital or electronic form, that are set up, received, or archived directly or indirectly by TOTAL, in particular in its information systems. These elements are used as evidence to establish, inter alia, the grounds for Crew selection. 6.2. Crews agree not to dispute the admissibility, validity or conclusiveness of the above-mentioned elements in either digital or electronic form, on any legal grounds whatsoever stating that some documents must be written or signed by the parties concerned in order to be considered valid. The above-mentioned elements are considered evidence and as such, if produced by TOTAL in the event of any dispute, legal or otherwise, they will be considered wholly admissible, valid and opposable between the parties in the same manner, under the same conditions and with the same conclusive force as any document drawn up, received or archived in writing. Article 7: PRIVACY POLICY 7.1. Contact details for all contestants are used in accordance with the French law dated January 6, 1978 relating to data processing, files and freedoms. Contestants have the right to access, correct or withdraw their personal data. 7.2. Team TOTAL contestants are automatically signed up to the TOTAL Newsletter. They may unsubscribe at any moment. 7.3. Contestants hand over the right to use their personal image to the TOTAL Team Contest organizers and their press partners for publicity and other purposes. Article 8: CONTEST DATES AND MODIFICATIONS 8.1. These Terms and Conditions apply to all Crews and Crew members participating in the Contest by completing and submitting an enrolment application. 8.2. TOTAL reserves the right to modify the Terms and Conditions and/or Site at any moment, without notice or requirement to explain the modification. TOTAL declines any and all liability arising from these modifications. 8.3. Any modification to the Terms and Conditions will be deposited with Alain SARAGOUSSI, Bailiff, 79 rue Réaumur, 75002, Paris, France, and will come into effect as of its publication on the Site. By their participation in the Contest, Crews and Crew members tacitly accept modifications as of the date of their publication on the Site. Crews or contestants that refuse the modifications automatically withdraw from the Contest. 8.4. TOTAL reserves the right to cancel the Contest at any time, without notice or requirement to explain the cancellation. TOTAL cannot be found liable for this cancellation and Crews and Crew members cannot make claims for any damages of any kind. 8.5. TOTAL reserves the right to prosecute any perpetuators of fraud or attempted fraud. TOTAL is not liable for damage potentially caused to Crews or Crew members by fraud or attempted fraud. 8.6. Where a Crew or Crew member does not comply with these Terms and Conditions, TOTAL reserves the right to disqualify the Crew involved with no possibility of appeal. Article 9: APPLICABLE LAWS These Terms and Conditions are governed by French law. Article 10: INTERPRETATION Any doubt concerning the application or interpretation of these Terms and Conditions, or any unanswered question, will be decided upon without appeal by TOTAL under the direction of Alain SARAGOUSSI, Bailiff, 79 rue Réaumur, 75002, Paris, France, depositary of the Terms and Conditions in accordance with French law. Article 11: DEPOSIT AND CONSULTATION OF THE TERMS AND CONDITIONS 11.1. The complete Terms and Conditions are deposited with Alain SARAGOUSSI, Bailiff, 79 rue Réaumur, 75002, PARIS. 11.2. The complete Terms and Conditions are consultable on the Site. 11.3. Participation in the Contest implies unconditional compliance with these Terms and Conditions in their entirety, with netiquette, and with applicable French laws, regulations and other legal texts. |
